Obamacare, Taxes & Americans’ Freedom

Having read Chief Justice Roberts Supreme Court decision regarding the Patient Protection and Affordable Care Act otherwise known as "Obamacare," it is worth noting that Justice Ginsburg and associates' commentary as well as that of the dissenters were individually longer than the Court's decision. It is also noteworthy that their lengthy expositions are in a word, irrelevant. The Court's decision written by Chief Justice Roberts stands and is all that matters. Whether or not those on either side of the fight agree or disagree with the decision is also irrelevant, except to the extent that as the Chief Justice wrote:

"Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments. Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices." (underline is mine.)

The Court decided that the individual mandate, i.e., everyone is required to buy health insurance contained in "Obamacare" is not constitutional under the Commerce Clause thereof. But, in seeking a way to avoid overturning the law Justice Roberts found that it is constitutional if what the Democrat Congress inserted as a penalty provision is in fact a tax in deference to the Administration's argument before the Court, i.e., "We called it a penalty, but really it is a tax." That is, if the payment to the IRS is a penalty absent procurement of health insurance, the law is unconstitutional. But since it is in fact a tax and not a penalty, the law is constitutional. He then went on to analyze and explain why it is a tax, and then determined it to be so. Therefore, no matter how many times or how loud democrats crow, "it is not a tax, it is a penalty," it remains a tax. In fact, if it is not a tax, it is not constitutional and the law is dead, and is only constitutional if the exacted payment is a tax.

Since the law has been declared constitutional and the individual mandate legal, it means that the numerous additional revenue provisions of the law in force are also taxes. The net result is that Obama and the Democrat Congress have foisted onto the American people the largest tax increase in history. But wait! That's not all, unless the Bush era tax cuts are not made permanent law on January 1st, 2013, the law will revert to Clinton era tax increases which at the time were the largest tax increases in history. The net effect of those combined taxes will be economically crushing and in effect turn working Americans into tax slaves of the Federal Government. For those who have not yet figured it out, “Obamacare” is a major factor in Obama's effort to "spread the wealth around."

The salient feature of both the aforementioned taxes, i.e., the individual tax to support “Obamacare” and the reversion to Clinton era taxes, is the fact that the greatest impact is on those making less than $200 thousand dollars, which is about 95% of all Americans. But since those in a lower economic status would pay no health care taxes, their share of the tax burden would be folded back onto the middle class and to a lesser extent the wealthiest. Even if the top five percent of the population were to pay 90% of their incomes it would be only marginally effective in reducing the tax burden that is positioned to fall directly on middle class earners.

In his acceptance speech at the Democrat nominating convention Obama said,

"I will cut taxes for 95 percent of all working families. Because in an economy like this, the last thing we should do is raise taxes on the middle class."

The question for any sentient being, "does what is likely to add up to fifty percent taxes or more, comply with Obama's promise?" The answer is "no" which he knew when he said it and who knows it now but hopes that with the help of the so called "mainstream media" most Middle Americans won't notice.

If Republicans have even one active brain cell in operation they will not allow Democrats to get away with this approach to effectively transform the nation into another socialist state. The forthcoming election is about whether or not Americans want to have the freedom to choose in the future. The presumptive Republican nominee, Mitt Romney has promised to repeal “Obamacare” as his first official act. He cannot do that alone, he must have support in both Houses of Congress which means Democrat Senators have to be replaced with conservatives and Republicans have to be re-elected in the House of Representatives.

If this law is allowed to stand, in the words of Justice Kennedy, "The mandate fundamentally changes the relationship between citizens and the federal government," and that is precisely what Democrats want. More government control, more spending, more taxation, more regulation and those combined equate to less individual freedom. Chief Justice Roberts' words, "It is not our job to protect the people from the consequences of their political choices," are fundamental to the maintenance of freedom. Therefore, if freedom loving Americans want to preserve that priceless "commodity" they must pray hard, work hard, donate, participate and VOTE. Roberts just handed the election to Romney if he is man enough to step up and take it. We hope that he is.
